  2. The constitution of the Union of Burma (UB) 1947 remains to be a legitimate constitution adopted by the people elected constitutional Assembly of the Union of Burma on September 24, 1947. It was thus implemented or enforced throughout the post independence period before it was banned by the illegal government of the revolutionary council led by General Ne win and his cronies.

The act of over throwing people elected government with the force of arms was purely waging war against the Union of Burma. Ne win and his cronies then were to be hung to death if the population of the Union of Burma could restore democracy that is bound to revive the Union constitution 1947 for sometimes before it is amended in federal form which was the reason why NeWin over threw the constitutional government against the constitution itself.

The constitution of Socialist Republic of the U B 1974 was adopted in fraud and duress with the force of arms having no any legitimacy as there was also no independent agents to check whether the referendum in 1974 was just and fair. The absence of independent agents to check whether the referendum was just and fair made the constitution illegitimacy. At the same time it was abolished in 1988 prodemocracy uprisings after which the country was ruled by the military regime by degree as an illegal government in ‘de fac to’ up to this very day,

The constitution of the Union of Burma 2008 also is adopted in fraud announcing that it was voted by 92 % before the vote was even casted and no country in the world recognize it as a legitimate constitution.

So the Burmese military regime is trying to hold the general election with the electoral law passed under the fake constitution of the UB 2008 in an attempt to make it to be a legitimate one. Their calculation could be that the constitution of the UB 2008 be deemed legitimate to be recognized internationally if the majority population in the country go to vote pro or against any candidate in the general election as the majority population of the country going to vote will be interpreted as majority people vote in the election means the majority people in the country go to vote as they support the constitution of the Union 2008.

If the population votes in majority in 2010 election, it will be interpreted that people go to vote in the election as they support the Constitution of the UB 2008. So the constitution will be internationally recognized and there will be no international support and assistance to the democratic forces as the military government will become international recognized legal government.

Thus no international support and assistance be available for democracy forces as the international organizations and many countries will say that the UB has been under a constitutional government and there is no legal way to intervene in the internal affairs of the UB and the country will be perpetually under the militarism.

Thus, if the population of the UB in the county is in unity against the military rule, no one is to go to vote in the 2010 general election to show and express to the world that the population of the U B is totally against the rule of fascist militarism. This is the easiest way for every citizen of the Union to show their support of democracy led by Daw Aung San Suu Kyi and her father, the late General Aung San of the UB’s hero…

In this way can the population bring down the military regime with the continued international support we are having today as the military regime will remain illegal government as “no vote” in 2010 election will mean not recognizing the 2008 Constitution by the population of the UB.

So it is only the Constitution of the Union of Burma 1947 which is remaining as a legitimate constitution of the UB. Thanks, Lnk.
